Terms & Conditions

These terms and conditions contain legal obligations and we encourage you to read through them carefully. Unless otherwise started, any purchases made through matthieuwaddellphoto.com are subject to these terms and conditions.

1. Our contract

All bookings are made with Matthieu Waddell Photo. By making a booking, the client is deemed to have agreed to these terms and conditions on behalf of all individuals included in the photoshoot.

2. Pricing and payments

2.1 Pricing

Price changes — The prices appearing on the website are the current rates and can change without notice. Once a client has booked a photoshoot, he/she is not be required to pay any difference in the event of a price increase.

Payment

a) Credit cards — Matthieu Waddell Photo accepts the following credit cards for payment:

b) Credit card service fee — Matthieu Waddell Photo does not charge clients a service fee on credit card payments; however, we are incorporated in France and our bank account is also domiciled in France. Some banks have been known charge their customers a small fee for what they see as an international transaction. Please check with your bank prior to purchase if this will affect your payment.

c) Payment due — Full payment is required at the time of booking.

3. Copyright

3.1 Copyright

All images produced by Matthieu Waddell Photo are proprietary and not to be used, copied, distributed or shared without express written permission. All images are protected by French and international copyright law (all rights reserved) and may not be reproduced in any manner without Matthieu Waddell Photo’s explicit written permission. The client has limited copyright ownership of the final images which may be used only for personal use. The client may make prints for personal use and sharing, as well as use for their personal blogs, sites, and social networks. The Client must obtain written permission from, and compensate Matthieu Waddell Photo prior to selling the images for profit.

4. Cancellations

4.1 Cancellation fees

Unless otherwise specified, the cancellation policy is as follows:

Cancellations made more than 48 hours prior to the scheduled photoshoot receive a full refund;
Cancellations made 48 hours or less prior to the scheduled photoshoot require the client to pay for the photoshoot in full, and no refund will be issued.

4.2 Force Majeure

If Matthieu Waddell Photo cannot perform this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or fee to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event Matthieu Waddell Photo fails to perform for any other reason, Matthieu Waddell Photo shall not be liable for any amount in excess of all monies paid.

5 Photos and marketing

5.1 Turnaround time

Within 48 hours of the photoshoot, the photographer will share low resolution versions of all technically valid images via a password protecting online gallery for viewing and selection purposes. The images in the online gallery are not downloadable. After receiving the client selections, the high resolution retouched jpeg images will be delivered to the client within 5 business days by WeTransfer using the email provided at the time of purchase. Turnaround time can vary depending on the number of images ordered and during high season.

5.2 Marketing

The client consents to allow Matthieu Waddell Photo to use selected images taken during the photoshoot which we agreed upon in advance for advertising and promotional purposes in any medium Matthieu Waddell Photo chooses. You grant Matthieu Waddell Photo a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

No show

Please allow enough time to be at the meeting point at least 5 minutes before your official start time. If you know you are going to be late, please call with the telephone number provided when you confirm. If you do not arrive on time and without any contact within 5 minutes of scheduled start time, you will be considered a “no show” and a new photoshoot must be booked and paid for. No refund will be provided in case of no show.

Updating of terms and conditions

Matthieu Waddell Photo reserves the right to update and/or alter these terms and conditions at any time. The latest terms and conditions can always be found on the website matthieuwaddellphoto.com and will supersede any previous versions.

These conditions and any contract to which they apply are governed in all respects by French law with jurisdiction of the courts of France.
